Excerpt: ...R. stock-. __ 2,500 which said stocks and bonds were to be held by said firm, only as collateral security for any overdrafts which the plaintiff might make upon said firm, except that the United States bonds above named were also to be held as security for certain notes made by the Isle of Wight Company, which had been purchased or discounted by said firm. VI.----That on the 13th day of May, 1884, the said firm of O. M. Bogart & Co. borrowed on call from the defendants Savin & Vanderhoof, as such copartners, the sum of $50,000, and deposited with them as collateral security therefor the following stocks and securities, viz.: One hundred shares of Missouri Pacific stock (certificate No. 9,728); Two hundred shares of Western Union Telegraph stock; Four hundred shares Chicago Milwaukee and St. Paul R. R. stock; One hundred shares Union Pacific R. R. Co. stock; Two hundred shares Philadelphia and Reading R. R. Co. stock; And at the same time received from the said Savin & Vanderhoof their check for the said sum of $50,000. That the one hundred shares of the stock of the Missouri Pacific R. R. Co. so pledged by the said firm of O. M. Bogart & Co. to the defendants Savin & Vanderhoof was the property of the Plaintiff, and stood in his name upon the books of the Missouri Pacific R. R. Co., and was a part of the security that had been deposited by the Plaintiff with the firm of O. M. Bogart & Co. as aforesaid. That said pledge of said Missouri Pacific stock was wrongfully made by the said firm of O. M. Bogart & Co., and was without the knowledge or consent of said plaintiff.
