A licensed brewer may bottle malt and brewed liquor of his own manufacture without taking out a bottler's license. The Act of March 31, 1856, 3, authorizing licensed brewers to bottle and sell and deliver malt and brewed liquors in quantities not less than one dozen bottles has not been repealed either diiectly or by implication. Case stated. C. P. Northampton Co. August-Term, 1886, No. 29. The facts appear by the opinion of the court. H. J. Steele and H. S. Oavanaugh, for plaintiff. C. A. Sandt, for defendant. The opinion of the court was delivered September 27, 1886. Schuyler, P. J.--The plaintiff is a licensed brewer, having his place of business within this county. In addition to manufacturing malt and brewed liquors under his license, plaintiff also carried on the business of bottling said liquors. While thus engaged, he was notified by the county treasurer that he must take out a bottler's license, and he did so, paying for the same $53.75, under protest. By the terms of the case stated, if the plaintiff was compelled to take out a bottler's license to enable him legally to bottle malt and brewed liquors of his own manufacture, then judgment is to be entered for defendant; otherwise, judgment to be entered in favor of the plaintiff for $53.75. It is not stated, nor is it contended, that the plaintiff bottled and delivered his goods in quantities less than a dozen bottles, and this licensed brewers are expressly authorized to do bv Act of March 31, 1856, 3, P.
