The case implicitly ratified the secession of the state of West Virginia from the state of Virginia, and explicitly ratified that the counties of Berkeley and Jefferson were part of West Virginia. Associate Justice Samuel Freeman Miller wrote the decision for the majority, joined by Chief Justice Salmon P. Chase and Associate Justices Samuel Nelson, Noah Haynes Swayne, William Strong, and Joseph P. Bradley. Associate Justice David Davis wrote a dissent, joined by Associate Justices Nathan Clifford and Stephen Johnson Field.
