Application may be made, although the estate of the person applying may be subject to charges and incumbrances. (a) Orders 1 and 2: Form A. (i) Or owners (13 & 14 Viet. e. 21, s. 4). (c) That is, of the beneficial interest, though the legal estate may be outstanding. (d) Whether as joint-tenants or tenants in common. The description will likewise apply to persons whose estates collectively constitute the fee simple. (e) By appointment, disentailment, or otherwise. (f) That is, persons having such a power of appointment of the fee as they might legally execute for their own benefit. (g) Not mere donees of a power of sale. Trustees for sale will be able, under s. 132, to raise the costs of registration by mortgage.
