Not illustrated. 1902 edition. Excerpt: ...died in 1899, and petitioner, a son-in-law, now claims she was indebted to him for boarding furnished her during a period of four years. Mt-Cully's Estate. The law is well settled that the husband is primarily liable for the support and maintenance and other necessaries furnished his_ wife. And neither she nor her estate is liable therefor unless an express contract by the wife to pay be shown, or such circumstances be proved from which an implied contract will be presumed. In the present case petitioner merely alleges he is a creditor of the decedent, but fails to aver that she ever contracted or promised to pay him for the boarding furnished herself and husband during the period stated. This is material and ought to be alleged. The petition is therefore defective; but if petitioner desires to amend the petition in this respect, leave is given him so to do within ten days from this date. On failure to amend, the petition is dismissed. Manstield's Estate. Guardian--Removal--lS'ubjecling ward'-3 estate to risks. A guardian who has mismanaged his ward's estate and used his position as trustee in prejudice of his war-d's interests, and thereby subjected his Ward's estate to risks which will be avoided by his discharge, will be removed.
