The Man Who Founded The ANC - A Biography Of Pixley ka Isaka Seme (Paperback): Bongani Ngqulunga The Man Who Founded The ANC - A Biography Of Pixley ka Isaka Seme (Paperback)

It is well known that the African National Congress was formed in 1912 and is considered the oldest political organisation on the African continent. What is often not widely known is that the person who founded it was one Pixley ka Isaka Seme, a thirty-year-old black South African from Inanda outside the city of Durban.

What is remarkable about Seme’s achievement in founding the ANC is not only that he succeeded where most had failed at forging black political unity. It is also the speed at which he did it. He had just returned to South Africa from the United Kingdom and the United States of America, where he had been a student since he was a teenager. In slightly over a year the founding conference of the ANC was convened and he was at its helm as the main organiser.

Seme also established a national newspaper, became one of the pioneering black lawyers in South Africa, bought land from white farmers for black settlement right at the time when opposition to it was gaining momentum, became a sought-after adviser and confidant to African royalty, and was considered a leading visionary for black economic empowerment. And yet, when he became president general of the ANC in the 1930s, he brought it to its knees through sheer ineptitude and an authoritarian style of leadership. On more than one occasion he was found guilty for breaching the law, which partly led to him being struck off the roll of attorneys.

This book discusses in detail Seme’s extraordinary life, from his humble beginnings at Inanda Mission to his triumphs and disappointments across the continents, in his public and private life. When Seme died in 1951 he was bankrupt and his political standing had suffered greatly. And yet he was praised as one of the greatest South Africans ever to have lived. For all this, he has largely been forgotten. This biography brings the remarkable life of this extraordinary South African back to public consciousness.

Statutory Interpretation - An Introduction for Students (Paperback, 5th Edition): C.J. Botha Statutory Interpretation - An Introduction for Students (Paperback, 5th Edition)

Interpretation of statutes is about understanding enacted law-texts, that is, making sense of the legislative scheme applicable to the situation at hand. Statutory Interpretation: An Introduction for Students aims to teach students to interpret and apply legislation within the total legal environment.

Part 1 (‘Statute law’) introduces students to the different types and categories of legislation, the structural components of legislation, the sometimes confusing ‘codes’ used in legislative texts, and the challenges of applying old order legislation together with new legislation. Part 2 (‘How legislation is interpreted’) comprises a chapter on the theoretical foundations of interpretation and an overview of the basic approaches to statutory interpretation in South Africa, and a chapter dealing with the practical application of the rules of interpretation. Part 3 (‘Judicial law-making during interpretation, and peremptory and directory provisions’) deals with day-to-day applications, and Part 4 is a basic introduction to constitutional interpretation. Students are also introduced to less well-known aspects of statutory interpretation, such as deeming clauses, the suspension of legislation, sunset clauses, legalese, and the counter-majoritarian difficulty.

The fifth edition of Statutory Interpretation: An Introduction for Students is a user-friendly introduction to the basic principles of statutory interpretation. It is aimed mainly at undergraduate students, but practitioners will also find it useful. The rules and principles of statutory interpretation are explained using hypothetical situations and practical examples from case law and legislation.

Labour Relations: A southern African perspective is the seventh edition of a text first published in 1989 under the title Labour Relations in South Africa. At that time, it was the first comprehensive textbook of its kind and was hailed as having reached the finishing line when others were still at the starting block.

Since then continuous social, political and legislative developments, and the ever-changing labour relations scenario, have necessitated regular updates, as well as the more recent change to its title.

Like its predecessors, this edition uses the labour ‘relationship’ as its starting point, guiding readers through the establishment of labour relations systems, the key participants and interactions involved and the legislation governing these interactions. It does this by using detailed practical examples, explanations and real-life cases where applicable.

In various parts of this latest edition, the text touches on the Fourth Industrial Revolution, the nature of changes to come and the implications for the world of work.

Planning Law (Paperback, 3rd Edition): Jeannie Van Wyk Planning Law (Paperback, 3rd Edition)
Jeannie Van Wyk
R1,297 R1,073 Discovery Miles 10 730 Save R224 (17%) Ships in 4 - 8 working days

Now part of the Juta’s Property Law Library series, the third edition provides a comprehensive discussion of the core aspects of South African planning law.

The second edition, Planning Law (2012), reflected more of the new constitutional dispensation that brought with it not only a focus on values and equity, but also the development of an entirely new vision and structure for planning in the three spheres of government. It introduced some basic principles, addressed the apartheid roots of planning law in South Africa and gave detailed attention to the core of planning law.

Since the publication of the second edition, planning law has received increasing attention and the constitutional, legislative and jurisprudential framework has undergone significant contextual development. Evolving constitutional insights are providing a better perspective on the content of planning law and the impact of planning frameworks and decisions on government, in its three spheres, as well as owners and neighbours.

The Constitutional Court has, to a large extent, clarified the different planning competences and how these are allocated to each of the spheres of government. The enactment of the Spatial Planning and Land Use Management Act 16 of 2013 (SPLUMA) has paved the way for the discipline to develop considerably and to be more integrated. The resultant effect on planning law has been immense and has necessitated this new edition that has been reworked and updated in its entirety. Since planning law is multi-faceted, the book also deals with related administrative, environmental, local government and informal settlement issues. All the relevant legal principles and legislative provisions are amplified by discussions of applicable court decisions.

Law and economics has become a central course in U.S. legal education and for students majoring in topics like economics, political science, and philosophy. Cooter and Ulen provide a clear introduction to economic analysis and its application to legal rules and institutions that is accessible to any student who has taken principles of microeconomics. The book's structure is flexible, beginning with an introductory overview of economic tools followed by paired chapters in five core areas of law: property, contracts, torts, legal process, and crime. Students leave the course understanding how microeconomic theory can be used to critically evaluate law and public policy.

The Opioid Epidemic and US Culture - Expression, Art, and Politics in an Age of Addiction (Paperback): Travis D. Stimeling The Opioid Epidemic and US Culture - Expression, Art, and Politics in an Age of Addiction (Paperback)
Travis D. Stimeling
R580 Discovery Miles 5 800 Ships in 7 - 11 working days

The Opioid Epidemic and US Culture brings a new set of perspectives to one of the most pressing contemporary topics in Appalachia and the nation as a whole. A project aimed both at challenging dehumanizing attitudes toward those caught in the opioid epidemic and at protesting the structural forces that have enabled it, this edited volume assembles a multidisciplinary community of scholars and practitioners to consider the ways that people have mobilized their creativity in response to the crisis. From the documentary The Wild and Wonderful Whites of West Virginia to the role of cough syrup in mumble rap, and from a queer Appalachian zine to protests against the Sackler family's art-world philanthropy, the essays here explore the intersections of expressive culture, addiction, and recovery. Written for an audience of people working on the front lines of the opioid crisis, the book is essential reading for social workers, addiction counselors, halfway house managers, and people with opioid use disorder. It will also appeal to the community of scholars interested in understanding how aesthetics shape our engagement with critical social issues, particularly in the fields of literary and film criticism, museum studies, and ethnomusicology.

In an era of corporate surveillance, artificial intelligence, deep fakes, genetic modification, automation, and more, law often seems to take a back seat to rampant technological change. To listen to Silicon Valley barons, there's nothing any of us can do about it. In this riveting work, Joshua A. T. Fairfield calls their bluff. He provides a fresh look at law, at what it actually is, how it works, and how we can create the kind of laws that help humans thrive in the face of technological change. He shows that law can keep up with technology because law is a kind of technology - a social technology built by humans out of cooperative fictions like firms, nations, and money. However, to secure the benefits of changing technology for all of us, we need a new kind of law, one that reflects our evolving understanding of how humans use language to cooperate.

The State of Creativity - The Future of 3D Printing, 4D Printing and Augmented Reality (Hardcover): James Griffin The State of Creativity - The Future of 3D Printing, 4D Printing and Augmented Reality (Hardcover)
James Griffin
R2,536 Discovery Miles 25 360 Ships in 12 - 17 working days

Creativity has been integral to the development of the modern State, and yet it is becoming increasingly sidelined, especially as a result of the development of new machinic technologies including 3D printing. Arguing that inner creativity has been endangered by the rise of administrative regulation, James Griffin explores a number of reforms to ensure that upcoming regulations do take creativity into account. The State of Creativity examines how the State has become distanced from individual processes of creativity. This book investigates how the failure to incorporate creativity into administrative regulation is, in fact, adversely impacting the regulation of new technologies such as 3D and 4D printing and augmented reality, by focusing on issues concerning copyright and patents. This is an important read for intellectual property law scholars, as well as those studying computer science who wish to gain a more in-depth understanding of the current laws surrounding digital technologies such as 3D printing in our modern world. Legal practitioners wanting to remain abreast of developments surrounding 3D printing will also benefit from this book.

Celebrated legal scholar Kenji Yoshino's first book, Covering, was acclaimed--from the New York Times Book Review to O, The Oprah Magazine to the American Lawyer--for its elegant prose, its good humor, and its brilliant insights into civil rights and discrimination law. Now, in A Thousand Times More Fair, Yoshino turns his attention to the question of what makes a fair and just society, and delves deep into a surprising source to answer it: Shakespeare's greatest plays. Through fresh and insightful readings of Measure for Measure, Titus Andronicus, Othello, and others, he addresses the fundamental questions we ask about our world today and elucidates some of the most troubling issues in contemporary life.

Enormously creative, engaging, and provocative, A Thousand Times More Fair is an altogether original book about Shakespeare and the law, and an ideal starting point to explore the nature of a just society-and our own.

Dr. Jopie Breed President: SAOU

With experience as both a trial and appellate judge, Charles Benjamin Schudson knows the burdens on judges. With engaging candor, he takes readers behind the bench to probe judicial minds analyzing actual trials and sentencings-of abortion protesters, murderers, sex predators, white supremacists, and others. He takes us into chambers to hear judges forging appellate decisions about life and death, multimillion-dollar damages, and priceless civil rights. And, most significantly, he exposes the financial, political, personal, and professional pressures that threaten judicial ethics and independence. As political attacks on judges increase, Schudson calls for reforms to protect judicial independence and for vigilance to ensure justice for all. Independence Corrupted is invaluable for students and scholars, lawyers and judges, and all citizens concerned about the future of America's courts.
