The afiidavit of Daniel Cleveland states his knowledge of the land of Turner, that it has been greatly benefited by the Canal, and the reasons why. That the ditch cut by Turner is of no advantage to the lands of the other propn'etors, and without the canal is of little benefit to the lands of Turner, and that Turner has enjoyed great advantages from the canal. That deponent was at the letting of the job to Kinnie, and that deponent, with the consent of Kinnie and the commissioners, agreed to perform, and has performed, one-third of the work so let to KUlVQT, and was to receive one-third of the contract rice, and he has only been allowed by the commissioners that sum; t at the whole job has been well and faithfully performed accordine to the specification, and that he believes the bill of assessment todoe just and equitable. There are fourteen aflidavits of other parties fyled with a view of establishing the fact that it has been and still is the practice to elect proprietors commissionms; that the lands of Turner have been more benefited than others, that the job was performed accordinw to specification, and that the commissioners acted fairly and equitadfly.
