Not illustrated. 1860 Excerpt: ...in the road, in order that it may, at the earliest possible day, pass into the hands of the proper owners. Proceedings have been commenced to foreclose the Second mortgage on the Eastern Division, and the First and Second mortgages on the Western Division. Creditors and parties claiming an interest in the road, are resisting these foreclosures. The holders of bonds, uuder the Second mortgage on the Western Division, are questioning the valid ity of a portion of the bonds issued under the First mortgage of that Division, and a similar question has arisen among the holders of that issue. The determining of those questions by the Court will occup y a long time, and involve much expense. In the m eauwhile, the interests of the road will suffer from the inability ol the Receiver to meet all the liabilities and obligations devolving upon the road. I repeat, again, that the interest of the road re quires an early settlement of these questions and conflicting rights--a re-organization under the laws of the State, and the formation of a company recognizing the rights of all, according to their re spective priorities and equities, which will be enabled successfully to manage this great thoroughfare as one entire line, from Milwaukee to La Crosse. It is proper to say that I have submitted the foregoing exhibit to the Judge of the U. S. Court, and have asked such order and direction as will enable me to protect the property, and promote the interests of the road. Trevorton Coal and Railroad Company.
