1839 Excerpt: ...for leases of 21 years, yet Your Committee
consider the tenant's right of renewal to be 247. c 3 a claim.a
claim upon custom and the good-will of the Lessors, who possess,
and have in some cases exercised the power of running out leases,
as well as alter the amount of fine upon renewal, and convert the
nature of the tenure frojn lives to years without attention to the
difference of value thereby allowed to the lessee, rather than any
right capable of being enforced by law or equity. Considering this,
therefore, the proper description of the amount of interest in the
property to be allowed to the lessee, it is apprehended that an Act
similar to the 39 Geo. 3, c. 21. c. 108, would undoubtedly bestow
upon the Church dignitaries a profit corresponding with that which
has been found to accrue from it to the Crown, but would leave the
lessee in a worse position than his present. Another consequence
would be, whether a desirable one or not, that the increase of
value would be an increase of income, for each particular
dignitary, and not for the formation of any surplus fund. The
principle of the Church and Corporation Land-tax Act was to
establish a commission to facilitate voluntary arrangements for the
disposal of Church Lands, always, in the first instance, to the
lessees, in order to redeem the tax. The total amount of sales,
under the authority of the Commissioners, is 1,460,010 1. 12. 10d.,
a large proportion of which was for that redeemed by ecclesiastical
corporations. These sales have taken place in a period of 40 years,
by voluntary bargain. Perhaps, under a similar authority, a
satisfactory, but slow, process of enfranchisement might be
established, to a certain extent, throughout the kingdom. At the
