Par. 4. cap. ss That whoever Marries in 2 clandestine unorderly Way, or by Persons not Authorized by the Kirk, (hall be Imprisoned for three Months, and beside (hall pay, the Nobleman an thousand libs, the Gentleman and Burgess five hundred libs, and each other person an hundred merles; and that they remain in Prison while they pay, amd the Fines to be applyed to pious Uses of the Paroch where they dwell; that the Celebrator be Banished, not to return under the Pain oi Death; That none of the Parties, where both reside in Scot' land, get themrelves Married in England, without Proclamation of Banns in Scotland, and against the order of this Kirk, under the Fain, a Nobleman a thousand libs, a Landed Gentleman a thousand meriS, a Burgess five hundred libs, each 01 her substantious Person five hundred merits, a Yeoman a hundred libs, and each inferior Person a hundred merfy, half to the King, half to the Paroch: Andthac the King or Kirks Advocate pursue the Contraveener of this Act, and that such as are unable to pay, be punished with Stocks and Irons, and all without prejudice of the Kirk-Censures.
