Excerpt: ... tody, possession, or power, or in the custody, possession, or power of nny other person for his use and benefit, in any wise appertaining to the manor, messuages, hinds, tenements, and hereditaments comprised in the said act of parliament in the said complainant's bill mentioned, except the said deeds of the 4th and 6th of May, 1786, &c., this defendant doth plead thereto, and for plea saith, that in the month of May, 1786, James Walwyn of, &c. deceased, the father of the said complainant, and in the said bill named, being in the quiet possession of the premises hereinafter mentioned, and alleging himself, and pretending to be seised in fee in possession of the said messuages, lands, tenements, and hereditaments, hereinafter particularly mentioned and described, and being in the actual possession of such freehold premist-s as apparent owner thereof, being also in the actual possession of I he title deeds and evidences relating thereto, as apparent owner thereof, and having the disposal thereof, he, the said James Walwyn, in the month of May, 1706, applied to Richard Little, of Kensington, in the county of Middlesex, Esq. to lend and advance him the sum of 3000/., byway of mortgage, on the said freehold premises, and the said Rich ird Little, believing the said James Walwyn to be entitled to the fee simple and inheritance of tlie said freehold premises, and to have the right of disposing thereof, and of the title deeds and evidences relating thereto, agreed to lend and advance the said James Walwyn the snid sum oi'3000/. upon such security: whereupon certain indentures of lease and release were duly made and executed by the said James Walwyn, dated respectively the 4th and 5th of May, 1786, between the said James Walvryn of the one part, and Richard Little ...
