The petition of sundry of the inhabitants of the town of Exe tor representing unfair practices at their last meeting for choice of Representatives being read, and all the parties-& their evidences being heard thereon according to the order of this house Novr26lh 1755, and the subject matter of said Petition being fully debated in said house--Voted, That the election of Col. Peter Gilman & Mr. John Phillips was unlawful and that it be accordingly set aside, and that a Precept go forthwith from y Speaker of this House to the Sheriff of the Province requiring him to send a precept to the selectmen of Exeter, requiring them to Summon the Freeholders of sd Town of Exeter to convene together at some convenient place iu said Town (giving them eight Days Notice at least) & to choose two suitable Persons to represent them in General Assembly of said Province now setting & to Direct them to notify said persons so' chosen to give their attendance in this house on Wednesday the 17th day of Dec/ inst. if the General Court be then setting, if not on the first day of the setting of the Court afterwards it to make Report of their doings therein unto the sheriff of sd Province at or before the sd 17th day of Dec' Inst, which Report the Sheriff for the time being i.s hereby ordered to deliver to the Speaker of this House on said Day.
