Excerpt: ...or adjudged to be void, nor will its validity be affected on account of any want of jurisdiction or authority in such supposed justice or minister, if it was consummated with a full belief of the persons so married, or either of them, that they have been lawfully joined in marriage. Id. 1464, Sec. 16. A marriage between parties capable of entering into that relation will be good and valid, whatever the form of the ceremony may be, or even if all ceremony be dispensed with, if the parties presently ag/ee to take each other as husband and wife, and from that time live together professedly in that relation. 31 Mich. 126. The difficulty which may exist in making the proof of such a marriage after the lapse of many years, and when important rights or interests may depend upon establishing the fact oI its having taken place, constitute a very substantial reason for having the marriage ceremony performed in such manner that the evidence of it may be perpetuated by a record. A formal ceremony of marriage, whether in due form or not, will be assumed to be by consent of the parties, and therefore prima facie a contract of marriage by a present agreement between the parties. 27 N. Y., 329. When no local law makes it void, a marriage by present agreement between parties capable of contracting it, is said to be of common right, and valid by a common law prevailing throughout christendom. 3I Mich. 132. Fees 0f justice. The justice is entitled to two dollars for marrying and making the record and certificate thereof required by law. Comp. L., 2053, Sec, 15; Laws of 1873, p. 13o. SECTION III.
