Debating Humanitarian Intervention - Should We Try to Save Strangers? (Paperback): Fernando Teson, Bas Van Der Vossen Debating Humanitarian Intervention - Should We Try to Save Strangers? (Paperback)
Fernando Teson, Bas Van Der Vossen
R731 Discovery Miles 7 310 Ships in 7 - 11 working days

When foreign powers attack civilians, other countries face an impossible dilemma. Two courses of action emerge: either to retaliate against an abusive government on behalf of its victims, or to remain spectators. Either course offers its own perils: the former, lost lives and resources without certainty of restoring peace or preventing worse problems from proliferating; the latter, cold spectatorship that leaves a country at the mercy of corrupt rulers or to revolution. Philosophers Fernando Teson and Bas van der Vossen offer contrasting views of humanitarian intervention, defining it as either war aimed at ending tyranny, or as violence. The authors employ the tools of impartial modern analytic philosophy, particularly just war theory, to substantiate their claims. According to Teson, a humanitarian intervention has the same just cause as a justified revolution: ending tyranny. He analyzes the different kinds of just cause and whether or not an intervener may pursue other justified causes. For Teson, the permissibility of humanitarian intervention is almost exclusively determined by the rules of proportionality. Bas van der Vossen, by contrast, holds that military intervention is morally impermissible in almost all cases. Justified interventions, Van der Vossen argues, must have high ex ante chance of success. Analyzing the history and prospects of intervention shows that they almost never do. Teson and van der Vossen refer to concrete cases, and weigh the consequences of continued or future intervention in Syria, Somalia, Rwanda, Bosnia, Iraq, Lybia and Egypt. By placing two philosophers in dialogue, Debating Humanitarian Intervention is not constrained by a single, unifying solution to the exclusion of all others. Rather, it considers many conceivable actions as judged by analytic philosophy, leaving the reader equipped to make her own, informed judgments.

Justice at a Distance - Extending Freedom Globally (Hardcover): Loren E. Lomasky, Fernando R. Teson Justice at a Distance - Extending Freedom Globally (Hardcover)
Loren E. Lomasky, Fernando R. Teson
R1,881 Discovery Miles 18 810 Ships in 7 - 11 working days

The current global-justice literature starts from the premise that world poverty is the result of structural injustice mostly attributable to past and present actions of governments and citizens of rich countries. As a result, that literature recommends vast coercive transfers of wealth from rich to poor societies, alongside stronger national and international governance. Justice at a Distance, in contrast, argues that global injustice is largely home-grown and that these native restrictions to freedom lie at the root of poverty and stagnation. The book is the first philosophical work to emphasize free markets in goods, services, and labor as an ethical imperative that allows people to pursue their projects and as the one institutional arrangement capable of alleviating poverty. Supported by a robust economic literature, Justice at a Distance applies the principle of noninterference to the issues of wealth and poverty, immigration, trade, the status of nation-states, war, and aid.

In Twist, Roni Teson has crafted a suspenseful tale of love, betrayal and intrigue with a cast of characters who will leap off the pages and stay in your heart long after the last page has been turned.

The Theory of Self-Determination (Paperback): Fernando R. Teson The Theory of Self-Determination (Paperback)
Fernando R. Teson
R745 Discovery Miles 7 450 Ships in 7 - 11 working days

When can a group legitimately form its own state? Under international law, some groups can but others cannot. But the standard is unclear, and traditional legal analysis has failed to elucidate it. In The Theory of Self-Determination, leading scholars chart new territory in our theoretical conception of self-determination. Drawing from diverse scholarship in international law, philosophy, and political science, they attempt to move beyond the prevailing nationalist conceptions of group definition. At issue are such universal questions as: when does a group qualify as a 'people'? Does history matter? Or is it a question of ethnic status? Are these matters properly solved by popular vote? Anchored in modern analytical political philosophy but with implications for a wide range of scholarship, this volume will prove essential for scholars and practitioners of international law, global justice, and international relations.

Rational Choice and Democratic Deliberation - A Theory of Discourse Failure (Paperback): Guido Pincione, Fernando R. Teson Rational Choice and Democratic Deliberation - A Theory of Discourse Failure (Paperback)
Guido Pincione, Fernando R. Teson
R938 Discovery Miles 9 380 Ships in 7 - 11 working days

In public political deliberation, people will err and lie in accordance with definite patterns. Such discourse failure results from behavior that is both instrumentally and epistemically rational. The deliberative practices of a liberal democracy (let alone repressive or non-democratic societies) cannot be improved so as to overcome the tendency for rational citizens to believe and say things at odds with reliable propositions of social science. The theory has several corollaries. One is that much contemporary political philosophy can be seen as an unsuccessful attempt to vindicate, on symbolic and moral grounds, the forms that discourse failure take on in public political deliberation. Another is that deliberative practices cannot be rescued even on non-epistemic grounds, such as social peace, impartiality, participation, and equality. To alleviate discourse failure, this book proposes to reduce the scope of majoritarian politics and enlarge markets.

This volume of the "Editio Maior Critica" of the works of Gregory of Nyssa, founded by Werner Jaeger, comprises the third and final part of the sermons of this fourth-century Church Father, which deal with a number of religious festivals as well as theological issues. The present work contains the following sermons: "De deitate filii et spiritus sancti et in Abraham" (ed. E. Rhein), "In diem natalem" (ed. F. Mann), "In sanctam Pentecosten" (ed. D. Teske), "Adversus eos qui castigationes aegre ferunt" (ed. D. Teske), and "De iis qui baptismum differunt" (ed. H. Polack). The edition is based on no fewer than 159 manuscripts, a clear sign of the major influence Gregory's sermons had on the life of the Church and on the theological debate. These codices are discussed in individual introductions which analyse how they interrelate, the results of which analysis are illustrated in a Stemma. The text is printed next to the apparatus criticus, together with the apparatus fontium. The book concludes with a number of indices which provide an overview of all sources of Gregory of Nyssa's work.

In the choice of a child's name the first symbolic inscription of a human being the parents' desire appears in filigree. When children are born, they are not a "tabula rasa," virgin of inscription. A pre-text precedes them, which is also a parental inter-text. The name becomes the written trace of the intersection of the parents' desires. Over this pre-text children write their own text and take possession of that name for themselves because of the singularity of its signs. The writing of the name remains as the indelible sign of a symbolic family history, a group palimpsest to which several generations often add contributions. Therefore, it is well worth going through this family book, following its movements, revealing its characters, recognizing this manuscript in cursive letters linked by bonds that run through several generations so that children may take possession of their first name."

Why should sovereign states obey international law? What compels them to owe allegiance to a higher set of rules when each country is its own law of the land? What is the basis of their obligations to each other? Conventional wisdom suggests that countries are too different from one another culturally to follow laws out of mere loyalty to each other or a set of shared moral values. Surely, the prevailing view holds, countries act simply out of self-interest, and they eventually consent to norms of international law to regulate matters of common interest. In this groundbreaking book, Fernando Teson goes against this prevailing thought by arguing, in the Kantian tradition, that a shared respect for individual human rights underpins not just the obligation countries feel to follow international law but also international laws themselves and even the very legitimacy of nations in the eyes of the international community. Teson, both a lawyer and a philosopher, proposes that an overlapping respect for human rights has created a moral common ground among the countries of the world; and moreover, that such an outlook is the only one that is rationally defensible. It is this common set of values rather than self-interest that ultimately provides legitimacy to international law. Using the tools of moral philosophy, Teson analyzes the concepts of sovereignty, intervention, and national interest; the contributions of social contact theory, game theory, and feminist theory; and the puzzles of self-determination and group rights.More than simply outlining his theory, Teson goes on to give detailed examples of international laws, international institutions, and their human rights foundations, puttinghis ideas to work and addressing legal reforms called for by the theory. He suggests that treaties, for example, should be considered binding if, and only if, the consent to the treaty was given by a genuinely representative government, one that acts out of interest for the human rights of its citizens. Although the theoretical achievement of this book is to challenge received wisdom on the foundation of international law, the practical ambition is a call to reform the international legal system for the post-Cold War era, to substitute for the old order one that gives primacy to human dignity and freedom over state power.
