The Freedom of Information Act (FOIA) is based on principles of openness and accountability in government. FOIA establishes that federal agencies must provide the public with access to government information, unless the information falls into one of nine specifically exempted categories (for example, certain information compiled for law enforcement purposes). However, agencies can use their discretion to disclose information even if it falls into one of the nine exempted categories; this is known as a discretionary disclosure. At the beginning of a new administration, the Attorney General traditionally issues a policy memorandum regarding FOIA, including policy on discretionary disclosure. Attorney General Ashcroft issued such a memorandum on October 12, 2001, replacing Attorney General Reno's 1993 FOIA memorandum. GAO was asked to determine (1) to what extent, if any, Department of Justice guidance for agencies on FOIA implementation has changed as a result of the new policy; (2) the views of FOIA officers at 25 agencies regarding the new policy and its effects, if any; and (3) the views of FOIA officers at 25 agencies regarding available FOIA guidance.

The Air Force based its Guide on existing NASA policy and procedures with respect to payload risk classification and launch vehicle certification. Payloads are classified based in part on factors such as national significance, payload complexity and cost, and are assigned a risk tolerance level accordingly. The Air Force, NASA, and NRO are working to coordinate and share information to facilitate launch vehicle certification efforts; however, each agency will determine for itself when certification has been achieved. As a result, some duplication and overlap of efforts could occur. The Air Force has also added other prerequisites to certification for new entrants that are not captured within the Guide, such as an approved implementation plan and a cooperative research and development agreement. According to the Air Force, these agreements are legal mechanisms intended to enable data sharing between the Air Force and new entrants, while protecting the interests of both.

The Global Positioning System (GPS) provides positioning, navigation, and timing (PNT) data to users worldwide. The U.S. Air Force, which is responsible for GPS acquisition, is in the process of modernizing the system. Last year GAO reported that it was uncertain whether the Air Force could acquire new satellites in time to maintain GPS service without interruption. GAO was asked to assess (1) the status of Air Force efforts to develop and deliver new GPS satellites, the availability of the GPS constellation, and the potential impacts on users if the constellation availability diminishes below its committed level of performance; (2) efforts to acquire the GPS ground control and user equipment necessary to leverage GPS satellite capabilities; (3) the GPS interagency requirements process; and (4) coordination of GPS efforts with the international PNT community. To do this, GAO analyzed program documentation and Air Force data on the GPS constellation, and interviewed officials from DOD and other agencies.

In 2010, after about 25 years of work and the expenditure of billions of dollars, the International Space Station (ISS) will be completed. According to the National Aeronautics and Space Administration (NASA), the ISS crew will then be able to redirect its efforts from assembling the station to conducting research. In 2005, Congress designated the ISS as a national laboratory; in addition, the NASA Authorization Act of 2008 required NASA to provide a research management plan for the ISS National Laboratory. In light of these developments, the Government Accountability Office (GAO) was asked to review the research use of the ISS. Specifically, GAO (1) identified how the ISS is being used for research and how it is expected to be used once completed, (2) identified challenges to maximizing ISS research; and (3) identified common management practices at other national laboratories and large science programs that could be applicable to the management of the ISS. To accomplish this, GAO interviewed NASA officials and reviewed key documents related to the ISS. GAO also studied two ground-based national laboratories and several large science institutions.

The purchasing, inventory management, and supply distribution practices of 21 short-term, general purpose hospitals were studied. Results of the study showed that centralization, which is essential to cost containment programs, was not employed to the fullest in hospital purchasing functions. Strong central management would maximize competition, value analysis, standardization, group purchasing, information sharing, accountability, and internal controls. Centralizing the responsibility for supplies provides an opportunity to improve inventory management. With centralized management, there is less risk of excessive buildup, shrinkage, lost charges, and obsolescence. Hospitals should assure that formal purchasing and inventory control procedures consistent with those used for general purchases are developed for pharmaceuticals. These procedures should include a system of internal controls to safeguard the integrity of all transactions and provide a mechanism for monitoring the pharmacy's purchasing performance. Maximum advantage should be taken of cost reducing techniques of pharmaceuticals, such as group purchasing and competitive bidding. Food purchasing practices indicated a need for improvement because food buyers have not: used quantitative methods for determining order quantities, reorder points, and inventory levels; maximized competition or participated in group purchasing; selected less expensive grades of food products; or established adequate internal controls. Hospitals have not solicited competition before purchasing contractual services. Responsibility for selecting contractors and monitoring performance was frequently decentralized.

Pursuant to a legislative requirement, GAO reviewed the effectiveness of royalty-sharing programs established under the Technology Transfer Act, focusing on: (1) federal scientists' interest in reporting inventions before and after the act's passage; and (2) the extent to which agencies' program implementation supports royalty-sharing incentives. GAO found that: (1) royalty-sharing programs at federal laboratories had little impact on scientists' interest in patenting inventions; (2) 14 of 21 agencies showed no improvement in the rate of patenting after the act's passage; (3) the small licensing rate increase provided no incentive to scientists to patent inventions; (4) most inventors received an average of $1,000 in shared royalties; (5) many scientists preferred peer recognition to monetary rewards; and (6) many scientists chose federal employment because it offered more freedom, creativity, and longer time frames for research than private-sector employment. GAO also found that: (1) agencies typically used formulas that gave inventors a small percentage of royalties; (2) many scientists did not know of the royalty-sharing programs, and believed that conflict-of-interest policies would hamper collaboration with industry; (3) many agencies did not capitalize on their inventors' successes to publicize their royalty-sharing programs; (4) agencies did not have adequate systems to ensure that inventors timely received royalty payments; (5) some agencies used the laboratory-share of royalties to pay administrative costs, rather than enhance laboratory research or personnel development; and (6) patenting delayed publication of research results, which was important to scientists' professional recognition.
