If, under a contract for the sale and subsequent delivery of goods, no right of property in which passes by the bargain, the seller fails to deliver the goods to the vendee, on the specified day, is the purchaser bound to accept and pay for the goods? 6. Where a purchaser agrees to take a car load of grain, if it is "good, salable grain," at a certain price, and the seller replies that he will accept the offer "for one car load of grain," may the purchaser recover damages if the grain is not salable? 7.
