In Cases where there are mutual debts between the par'ties, a defendant may plead the General Issue, and pay any sum of money into Court that he imagines the plaintiff' may recover, and give Notice of Set-off as to all the remaining sums stated in the Declaration; and as the Set-off must be delivered at the time of filing the Plea, it is commonly written at the foot thereof, on the same Stamp, in the following Form: --In the County-Court of Devon. 3 Joseph Right, Gent, one &c. plaintiff, Between-( and Richard Wrong, defendant. TAKE NOTICE, that tlie above-named defendant will insist upon and give in evidence at the trial of this Cause; that the said plaintiff, at the time of exhibiting his aforesaid Plaint against the said defendant, then was and still is indebted to the said defendant, at Exeter, in the County of Devon, within the jurisdiction of this Court, in more money than is due and owing from him to the said plaintiff upon or by reason of the supposed promises and undertakings in the said Declaration mentioned, (to wit, ) in the sum of one pound nineteen shillings and eleven-pence three farthings of lawful money of this realm, partly for divers goods, wares, and merchandises by the said defendant before that time sold and delivered to the said plaintiff at his special instance and request, at Exeter aforesaid, in the County aforesaid, and within the jurisdic...
