Distribution of Intestate's Property. The real property of an intestate descends to his heirs in accordance with the statute of descent in force where such property is situated. His personal property is distributed to his distributees, or next of kin, in accordance with the statute of distribution in force where the intestate had his domicile at his death. In many states, the intestate's real and personal property do not always devolve alike. Furthermore, realty which the decedent had acquired by purchase (which includes every mode other than descent) descends differently from realty which he had acquired by descent; and the devolution of the latter depends on whether it had descended on the part of his father or his mother. These differences existed in Maryland until the passage of the Act of 1916, Chapter 325, which provided that the real property of an intestate, whether acquired by descent or purchase, shall descend to the same persons and in the same proportions as then or thereafter prescribed for the distribution of the personal estate. At the present time, therefore, the surplus of an intestate's estate, real and personal, after the share of the surviving husband or wife is taken out, or the whole surplus if there be no surviving husband or wife, passes under the law of Maryland as follows: (1) To the children of the deceased, in equal shares; the descendants of any deceased child to take such share as the latter, if living, would have been entitled to. Every other descendant living at the death of the intestate stands in the place of his or her deceased ancestor, and in all cases those in equal degree claiming...
