Excerpt: ...the clerk of the county, city and county, or city to which it may apply, establish a minimum requirement concerning the matters covered by such order and shall be construed in connection with any local order relative to-the same matter and to amend or modify any requirement in such local order not up to the standard of the order of the commission. Sec. 461/, (new). If the condition of any employment or place of employment or the operation of any machine, device or apparatus shall constitute a serious menace of the lives or safety of persons about it, the commission, or a commissioner, may apply to the superior court of the county in which such place of employment, machine, device or apparatus is situated, for an injunction restraining the use or operation thereof until such condition shall be corrected. The said application accompanied by affidavit showing that such place of employment, machine, device or apparatus is being operated in violation of a general or special safety order of the commission, and that such use or operation constitutes a menace to the 'Chapter 586, Laws of 1917. Prohibiting use of dangerous machine. Notice. Safety museums. Lectures. Advisers. Safety orders as evidence. Penalty for violation. life or safety of any person or persons employed thereabout, accompanied by a copy of the order or orders applicable thereto shall constitute a sufficient prima facie showing to warrant, in the discretion of the court, the immediate granting of a temporary restraining order. No bond shall be required from the commission as a prerequisite to the granting of any restraining order.
