Section 1 of the Elkins Act makes it a misdemeanor, punishable by a fine of not less than $1.000. nor more than $20,000, for each offense. 94. New York Cent, etc., R. Co. which has neglected to file and publish its rates and charges for such service is a misdemeanor, under the Act to Regulate Commerce, Feb. 4, 1887, as amended by Act June 29, 1906, and under the Elkins Act. The requirement for filing and publication has been in the Act ever since the passage of the original Cullom bill, and its importance has been recognized by Congress by successive amendments designed to make it more precise and its violation more surely and more severely punishable. 5 Under Interstate Commerce Act, Feb. 4, 1887, 6, as amended by Act June 29, 1906, 2, which declares that every common carrier subject to the act shall file with the Interstate Commerce Commission and print, post, and keep open to public inspection schedules showing rates, fares, and charges for transportation between different points on its own route and points on the route of any other carrier by railroad, etc., in a prosecution against certain...
