Y. Oct. 31st 1868. G. B. & J. C. Daniels, New York. "/'/$3 Gents: I enclose bill of 35 lading per boat H. N. Farnum of Buffalo 2000 bbls, of apples, with insurance certificate, and against which A. Gutchess, will draw on you through us hereafter. Yours. J. N. Starin, Cashier." 36 And which were received by the defendants on the second day of November, 1868. Monday. " Eleventh. That on the same second day of November, 1868, Gutchess drew a draft on the defendants against said apples for $5,000, payable--to the order of Houghtailing and Grahain, and endorsed by them which draft was presented to the plaintiff, by Houghtailing on the morning of said second day of November, 1868, and by said plaintiff discounted, said bank paying therefor by giving credit 37 to Houghtailing, in whose name the acconnt of Gutchess, Houghta-iling and Graham, at said bank was kept, for $1,000, and paying the balance 1n cash at the time, and which draft is described in the complaint, and a...
