He said there was two thousand dollars more on the houses than he already said the same day. I believe it was the same morning he said there was twelve thousand_ on the corner house and ten thousand on each of the others. That would be sixty-two instead of sixty. At that time Mr. Brush said he would exchange the houses on that basis and authorized me to exchange them. After we got down to the proper figures, he reduced the price of the flats from $115,000 I think he started with. Mr. Brush put that price on them himself that morning. He had the diagram, was looking over it the night previous. and he had made up his mind what to ask. The $115,000 value was placed on the houses by Mr. Brush for a starter about the 5th of September, 1888, during the time we were negotiating the exchange in the conversation we had with regard to the exchange of the property on September 5----this same conversation that I am de tailing now. Q. How does it happen then that he said there was $2,000 more mortgage on the houses than he had said Z? A. The proposition was made through another broker to accept those houses with $60,000 mortgage, and take $48,000 worth of lots. He was Mr. Newkirk, he had the sale of the lots for Max Moses. He, Newkirk, said this to me, that they proposed to exchange those lots for the houses subject to $60,000. Q. How did he learn, if you know, that these houses were for exchange? A. He had this man all over the city in different parts, Mr. Moses, looking at different places where he wouldlike to locate, he wanted to get a good house. Q. ...
