Mr. Ulrich: Before this injury the attack upon Mr. Deitrich--1905. Statement of Facts. The Court: Proceed. " Q. Mr. Kratzer, did this dog attack you or attempt to attack you at any time? A. No, sir, he did not; not outside of the fence. He many a time jumped up at the fence that I passed, and barked loud, but not outside; that is, he never took hold of me. Q. Vas Mr. Kettering there at the time? A. Been in the yard different times; yes, sir. Q. Vhen the dog growled at you and jumped at you? A. Yes, sir. That is, understand, not at me; he was inside of the fence, and I was out." Cross-examination by Mr. Capp: " Q. Tell us in your own way what the dog did when you went by the place. A. Oh, well, he jumped up at the fence, you know, and reached outside of the fence and barked, you know, as though he was in the act of getting hold of me; but he never did, understand; I was outside and he was in. Q. He was a young dog, wasn't he-? A. I d0n't know how old he was. He was grown out, I think, because he was a dog very near as high as these boxes here. I judged him to be grown out, and probably two or three or four years old. Q. He did not jump up against the fence in such a way as to make an effort to break through? A. I would mther say it was. I think if the fence had been frail, and it would not have stood the jumping against, I think he would have come out and got at me; I think he would. Q. How often did this occur? A. I don't know.
