Bailey was born in Minisink, Orange County, New York on August 14, 1817. He graduated from Princeton College in 1837, where he studied law. Bailey was admitted to the bar and commenced practice of law. He served as examiner in chancery of Greene County, New York (1840 - 1842); justice of the peace of the town of Catskill for four years; member of the State assembly in 1849; and judge of Greene County (1851 - 1855).
