Not illustrated. 1901 Excerpt: ...be passed to the effect that the publication of an invention in specifications of Letters Patent granted in the United Kingdom dated 50 years or more previous to the date of the application, or in a provisional specification of any date of the kind before mentioned, shall not of itself be deemed an anticipation of the invention. 11. We recommend the following steps as suitable to give effect to the foregoing recommendations: (i.) That the result of this inquiry, when affirmative, shall be communicated to the applicant. (ii.) That a time, to be determined by general rules, but not ordinarily to exceed two calendar months, be given to the applicant to amend his specification, and if amended, an examination to be made in the Patent Office whether the specification is still open to objection on the ground mentioned in paragraph 10. (iii.) That a report be made to the Comptroller of the result of the aforesaid examinations. (iv.) That the provisions of Sub-section 8 of the 9th Section of the Patent Act, 1883, as amended by the Act of 1888, be extended to reports under this scheme. That amended enactment is as follows: "Reports of examiners shall not in any case be published or be open to public inspection, and shall not be liable to production or inspection in any legal proceedings, unless the court or officer having power to order discovery in such legal proceedings shall certify that such production or inspection is desirable in the interests of justice, and ought to be allowed." That if the Comptroller be satisfied that no objection exists to the specification on the ground that the invention claimed in the deposited specification has been wholly or in part claimed in one or more complete specifications of letters patent within the period above...
