False representations as to incumbrance on property insured, that is not indorsed on the policy, cannot lie pleaded or proved in defense of an action for loss under the statute. And where insured property has been purchased by a party, and an assignment of the policy of insurance made to him, with the consent of the insurance company, in an action by him to recover for a loss, the company cannot prove the false representations of the party who obtained the policy as to incumbrance on the property insured.
