The plaintiff, one of a number of persons who did the same, went on board a steamer to say good-bye to a friend who was travelling by her. Held, sufficient evidence to go to the jury that the plaintiff was there by permission of the owners, the jury lieing entitled to act upon their knowledge of the general custom. Motion To Set Aside A Non-suit. The declaration stated that " The defendants were possessed of a certain ship and carried passengers thereon, for reward to the defendants, and had the care, control and management of a certain gangway provided by the defendants as a means of communication between the.said ship and a certain wharf for the use of such passengers, and of persons visiting such passengers. And the plaintiff, being a person visiting a passenger by the said ship, was, by permission and at the invitation of the ilefendants, passing over the said gangway, in crossing from the said ship to the said wharf, and thereupon the defendants, by their servants, so negligently, carelessly and improperly conducted themselves in and about the care, control and management of the said gangway by having the same insufficiently lighted and by moving and altering the position of the same without any notice or warning to the plaintiff, and otherwise, that the plaintiff, then being on the said gangway, was violently thrown down, whereby the plaintiff," etc. Pleas: (1) Not guilty. (2) That the said gangway was not provided by the defendants as a moans of communication between the said ship and the wharf for the use of persons visiting passengers.
