Hill, Chairman: The rates now being charged by the applicant for manufactured gas which it distributes in the city of Niagara Falls were fixed by the Commission's order of June 12, 1919, at $1.90 per M cubic feet, with a cash payment discount of 15 cents, making the net rate $1.75 per M. This application, filed November 17, 1920, alleges that such rate is unreasonably low, and asks that the Commission fix reasonable rates. The local authorities of the city appeared in opposition. The rates and service and condition of applicant have been the subject of almost constant difficulty and contention between the company and the municipality for a number of years. An opinion was written as the basis of the order of June 12, 1919, which is reported in 8 P. S. C. N. Y. 2nd Dist., p. 233. A rehearing was had upon the applicant's petition. Further facts were proven and an additional record made, upon which applicant asked for an increased rate. A further opinion was written and an order made denying the application March 11, 1920. Vol. 9. 1920 Upon the present application both of the prior records were introduced and made a part of the record herein. For the facts developed, the findings made, and the views of the Commission in those proceedings, reference is had thereto and they will not be reviewed at ...
