If six months after the concurso is opened no tender shall be made, the part of the railway constructed, as well as the materials provided shall become the property of the State, the company being deprived of all its rights. Art. 25. In the cases of which the two preceding articles treat, the part of the deposit or caution money not then returned shall become the property of the State. Art. 26. In Arts. 23. and 24. are excepted the cases proved of "force majeure." Art. 27. As the works shall be completed for the opening of the line to public traffic, they shall be inspected by one or more government agents, who will make out a document describing the result of this inspection, which must be approved by the said Government previously to the line being definitively opened to public traffic. Art. 28. After the total completion of the construction of the railway, the Company shall establish kilometrical marks, and shall make a plan of the railway, with a description of all the works of art, and other dependencies. Art. 29. The expiration of the concession of which Art. 8. treats having arrived, the Company shall deliver to the Government in a good state of repair, the railway and its dependencies, including the ways, accessory buildings, and the working material. This delivery being made, the Government engages to reimburse the Company upon a valuation by competent persons, for the value of the rolling stock, in case this material has been bought after the net proceeds of the railway shall have reached to 6 per cent.
