Be it enacted by/the General Assembly of the State of Indiana, That the incorporated cities of this State are author ized 'by ordinance or contract, to grant to any person or cor-Pipesfor Stem poration the right to lay down pipes in their streets, lanes, 331:3; iii-e 3:1 alleys, thoroughfares and public grounds, for the purpose of em 1 l supplying the inhabitants thereof with steam, gas or water, for ' heating and motive power.' SEO. 2. An emergency existing therefor, this act shall be in force from and after its passage. Emergency" 1. Common Council may establish the grade of the street and require owners to make sidewalks correspond. 2. A city charter gave the Common Council full power to regulate and superintend the laying of gas pipes. The Council passed an ordinance authorizing the gas company tolay such pipes. A dangerous excavation was made by the company under such ordinance, and it appeared one of the Aldermen witnessed the work without objection. Held that the city was liable for injuries 'to one falling into the excavation while walking on the sidewalk at night.----6 Abb. (N. Y.) N. Cas. 246; 57 How. (N. Y.) Pr, 196. CHAPTER XLVII.
