The third field of State activity and regulation relates to the protection of the working people. VVhile in Adam Smith s day the purpose of regulations applicable to labor was to lower its price, the rule today is the opposite and the usual purpose and effect is to raise the price of labor, although many of the regulations do not relate to wages, but to the wel fare of the laborer. Notable in this class of legislation is the extensive adoption of workmen s compensation laws. At least 27 states have acted favorably in this respect. The underlying principle of these laws involves a departure from the limited liability of the master under the common law relative to master and servant, and a recognition that society at large, and labor in particular, are benefited by a general distribution of the burdens of accidents regardless of previously existing common law defenses, such as the dedefenses of contributory negligence, assumption of the risk and the fellow servant doctrine.
