Die Arbeit gibt einen Uberblick uber die Entstehungsbedingungen des Energiewirtschaftsgesetzes von 1935. Dargestellt werden die vor dem Ersten Weltkrieg unternommenen Beratungen eines Reichselektrizitatsgesetzes sowie die in der Weimarer Republik unternommenen Versuche zur Sozialisierung der Elektrizitatswirtschaft. Es zeigt sich, dass der NS-Gesetzgeber neben der Sicherung des staatlichen Einflusses vor allem die Kriegsfahigkeit der Energiewirtschaft gewahrleisten wollte. Grundlage der Arbeit sind die noch vorhandenen Materialien zu den Gesetzesvorlagen, von denen die wichtigsten im Anhang wiedergegeben werden. Die ausfuhrliche Darstellung der Beratungen in der NS-Zeit liefert die Grundlagen fur die Kritik an der Fortgeltung bzw. an den Versuchen einer verfassungskonformen Auslegung des Gesetzes."
